Club House Facilities not ready in various societies of Delhi NCR


Now a days all builders offered club house facilities in own residential projects. Most of these projects are under construction where they offered club house facilities. Builder charged 1 to 3 Lakh club membership charges as well as car parking charges when buyer booked their flat in society.

All builders create hype for Club premises, which includes infinity pool, gymnasium, meditation centre and swimming pool. All these club facilities specified in the property brochure and promised in the sale deed. But most of the builders in Delhi NCR not provide the clubhouse when apartments are ready for use and handed to the buyers. As per a Supreme Court Judgment in 2010, clubs are the part of common areas of the society and have to be handed over to the buyers just after possession has been given buy the builders.

One of the example is Lotus Boulevard in Noida Sector 100 where builder (The 3C company) already given the 1st phase of possession but their club facilities are not yet ready for the residents of 1st phase. Buyers already paid for their club membership but they can't use the undeveloped club Espacia.

If buyers delay their payment in under construction apartment then builders charge the penalty @ 18% whereas the builder pays only Rs. 5 per sq. ft. if they delays the apartment delivery not the club house facilities. Builder specified the penalty changes in builder buyer agreement but they not given any penalty to the buyers and said your apartment's super area has increase and you have to pay some amount for that and we will adjust your amount with the penalty charges.

If you are also one of the residents in this type of builder society you need to write to the concerned development authority and mention the issue of club amenities, which is, not provide the builder and they promise in the booking of apartment. If authority not showing the interest you can approach the high court or the consumer court and saying that the builder not providing the club house facilities.
